A Family Christmas Card

This is a very interesting case because there were faults on both sides in my opinion.  The store owner should have taken the photos' original posting into account or at least double checked before just taking it for his own use.  The family should know that if their blog is public, this means that anyone and everyone can take the information and images posted on there and do what they like with it.  Yes, the people using it should at least ask but if they find the picture on google and not on the original blog post then how would they know?
If this photo was used in a educational sense it would be harder for the family to have a case against the copyright violation if the picture was being used for educational purposes inside of a classroom.  If the educator was distributing this picture in a mass quantity then that would be a whole other copyright issue.  I can see the family still being upset that it is being used but that does not necessarily mean that they would win this copyright battle. If a student used this photo in a project and even cited where they got the picture from that does not mean it still does not legally break the copyright law (Hobbs, 76).
